This document outlines the terms and conditions for using our BI application that automates the creation of BI dashboards in Tableau using AI. Ponychart is not affiliated with Tableau.
1. Acceptance of Terms
By accessing or using the Application, you acknowledge that you have read, understood, and agree to these Terms. Continued use of the Application constitutes your acceptance of any future modifications. If you disagree with any part of these Terms, you must not use the Application.
2. License Grant and Restrictions
License Grant: We grant you a non-exclusive, non-transferable, revocable license to use the Application solely for generating BI dashboards as provided by the service.
Restrictions: You shall not:
- Copy, modify, reverse engineer, decompile, or otherwise attempt to derive the Application's source code.
- Redistribute, sublicense, or incorporate the Application into any other products or services.
- Use the Application for any purpose other than generating BI dashboards.
Any violation of these restrictions may result in immediate termination of your license.
3. User Obligations
The Application is provided exclusively for the purpose of generating BI dashboards.
You agree not to use the Application in any manner not expressly permitted herein, including embedding or integrating the Application into any other website or platform without prior written consent.
4. Intellectual Property Rights
Application Ownership: All intellectual property rights, including but not limited to technology, methodologies, and proprietary materials used in the Application, remain the sole property of Ponychart.
User-Created Dashboards: The dashboards generated by the Application are your property. You are free to use, market, sell, or otherwise dispose of them without restriction.
5. Disclaimer of Warranties
The Application and all services provided are offered on an "as is" and "as available" basis. To the fullest extent permitted by law, Ponychart disclaims all warranties, whether express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose.
- Any warranty that the Application will meet your requirements or operate without interruption or error.
The use of AI in the Application is inherently approximate and may produce errors. You assume all risk related to its use.
6. Limitation of Liability
Under no circumstances shall Ponychart be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Application. This limitation applies even if Ponychart has been advised of the possibility of such damages. You acknowledge that the AI-generated outputs are approximate and errors may occur.
7. Indemnification
You agree to indemnify, defend, and hold harmless Ponychart, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Application.
- Any breach or violation of these Terms.
- Any infringement of any rights of a third party by your use of the Application.
8. Termination
Subscription-Based Use: Your right to use the Application will terminate at the end of your subscription period or immediately upon your breach of these Terms.
Credits Mode: If you are subscribed to the "credits" mode, you may terminate your subscription at any time, subject to the specific terms of your agreement.
Ponychart reserves the right to suspend or terminate your access without prior notice for any breach of these Terms.
9. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
Dispute Resolution: Any disputes arising out of or in connection with these Terms or your use of the Application shall be resolved:
- Through binding arbitration in accordance with the rules of the International Chamber of Commerce, or
- In the courts located in Paris, France, as applicable.
Your agreement to these Terms constitutes your consent to the chosen method of dispute resolution.
10. Updates to Terms
We reserve the right to modify or update these Terms at any time. Notice of any changes will be provided via email or through the Application prior to the changes becoming effective. Continued use of the Application after such notice constitutes your acceptance of the revised Terms.
11. Miscellaneous
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between you and Ponychart regarding your use of the Application and supersede all prior or contemporaneous understandings or agreements, whether written or oral.
By using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
